India: Consumer Court Imposes 1 lakh INR Penalty on ITC for Missing Biscuit

September 10, 2023

ITC Limited, a prominent Indian conglomerate and a major player in the Fast-Moving Consumer Goods (FMCG) sector, has been handed a hefty 1 lakh INR fine following a consumer complaint about a single missing biscuit in a packet of Sunfeast Marie Light biscuits. The incident, which unfolded in Chennai, has garnered widespread attention for its implications on consumer rights and fair trade practices.

The Discovery: A Missing Biscuit Leads to Legal Action

The issue came to light when a local resident, P Dillibabu, purchased a packet of Sunfeast Marie Light biscuits with the intent of feeding stray dogs. However, upon opening the pack, he made a startling discovery – despite the label clearly indicating 16 biscuits, there were only 15 inside. Unsatisfied with the responses from both his local store and ITC, Dillibabu decided to take the matter to a consumer court.

Crunching the Numbers: Consumer Impact and Cost Analysis

In his complaint, Dillibabu meticulously calculated the cost per biscuit at 0.75 INR. Given ITC’s colossal daily production of 50,00,000 packets of biscuits, he estimated that consumers could potentially be shortchanged by a staggering 2,909,202.14 INR every day due to this biscuit count discrepancy.

ITC’s Defense and Its Rejection

ITC initially defended itself by arguing that biscuits are sold based on weight rather than quantity. Each packet of Sunfeast Marie Light biscuits prominently displayed a net weight of 76 grams. However, the consumer court’s scrutiny revealed that each pack containing 15 biscuits weighed only 74 grams.

The company also cited the Legal Metrology Rules of 2011, which allow for a maximum weight discrepancy of 4.5 grams in pre-packaged goods. However, the court rejected this explanation, emphasizing that such exemptions primarily applied to volatile products and did not extend to biscuits, which do not experience weight loss over time.

Furthermore, ITC’s claim that biscuits were sold based on weight rather than quantity was dismissed by the court, given that the wrapper explicitly mentioned 16 biscuits.

The Verdict: Consumer Court Rules in Favor of Complainant

In a verdict delivered on August 29, the consumer court ruled in favor of Dillibabu, ordering ITC to pay him $1,200 as compensation for engaging in unfair trade practices. Additionally, the court mandated that ITC cease the sale of the specific batch of biscuits in question.

This case serves as a significant reminder that consumer rights and transparency in labeling are of paramount importance, even for industry giants in the FMCG sector like ITC. It highlights the impact that seemingly minor discrepancies can have on consumers and underscores the need for companies to adhere to established regulations and standards.
