$117 Million Pork Antitrust Settlement May Provide Payments to Consumers

Consumers in 24 U.S. states and the District of Columbia may be eligible for payments from a $117.065 million class action settlement involving allegations that major pork producers conspired to limit pork supplies and increase prices.

The lawsuit, known as In re: Pork Antitrust Litigation, was filed in 2018. The settlement resolves claims involving Agri Stats, Clemens, Hormel, Seaboard, Triumph and Tyson. JBS and Smithfield had reached separate settlements in the litigation.

The companies have not admitted wrongdoing as part of the settlements.

Who May Be Eligible?

The settlement covers individuals and entities that indirectly purchased certain pork products for personal consumption between June 28, 2014, and June 30, 2018.

Eligible purchases generally include:

  • Raw pork bacon
  • Fresh or frozen pork made from bellies
  • Loins
  • Shoulders
  • Ribs
  • Pork chops

The settlement applies to purchases made in Arizona, California, District of Columbia, Florida, Hawaii, Illinois, Iowa, Kansas, Maine, Michigan, Minnesota, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Rhode Island, South Carolina, Tennessee, Utah and West Virginia.

Products Not Included

Certain pork products are excluded from the settlement. These include products marketed as organic or no-antibiotics-ever (NAE).

Pork products other than bacon that were marinated, seasoned, flavored or breaded are also excluded.

How Much Could Consumers Receive?

Payments will depend on the amount of eligible pork products purchased during the covered period. Valid claims will be paid on a pro rata basis, meaning the amount each eligible claimant receives will depend on the total value of eligible purchases and the number of valid claims.

Claim Deadline

Eligible consumers must submit a valid claim form online or by mail by October 29, 2026.

Consumers who are unsure whether their purchases qualify can use the official settlement’s product eligibility lookup tool to check their eligibility.

The court is scheduled to consider final approval of the settlement at a hearing on December 11, 2026. Payments will be distributed only after final approval and resolution of any appeals.

Consumers should verify their eligibility and submit claims only through the official court-approved settlement website.
